AN ANLYSIS OF THE CASE ON SANDRA PRIMROES V. WAL-MART STORES INC, business and finance assignment help

Option A: The assigned case for Session One, which you must locate using Lexis/Nexis

(see the Briefing the Case Instructions document),  is: Sandra Primrose v. Wal-MartStores, Inc., Louisiana Court of Appeal, Second Circuit October 2, 2013.

Analyze the assigned Case (That I have assigned and identified below)1. Review the instructions below AND(1) Review separate instructions/document on the Canvas module for Briefing a Caseand brief the case assigned for the relevant Contributions session Use the Lexis Nexis

database in the King Library. You will need your library card and PIN. On the LexisNexis home page, scroll down to the middle center, Look Up a Legal Case, and enter thename of the plaintiff in one box and the defendant in the other. Then search.  In someinstances, the name of a case will appear more than once. Be sure to locate the case usingthe information (what court? Appellate? Supreme Court? What date?)

First Brief the case following the format instructions. Remember that there is “No Credit”

for briefing any textbook summary of a case: you must provide evidence you read thereal opinion in Lexis Nexis (what facts would be added, for example, to any textbooksummary. What is the name of any statute? What court cases did the court cite and whatfacts did the court use in its opinion (might be facts not in your summary of the facts).

 2. After you have completed your briefing of the case, answer the following fourquestions. Some guidelines are here and a few reminders are also located on thedocument for Briefing a Case:

1. What legal concepts in the textbook (use assigned chapters only) address legal issuesin the case? (Provide textbook pages or legal concepts—the more focused the better.). (Alist with brief commentary for clarity is fine)

2. Did those involved in the controversy leading to up to a lawsuit behave ethically?Focus on the individuals or organizations (not the court).  Use more than one recognizedethical theory/approach. Use the ethics handout as well as lecture notes and the textbook(chapter 2).  Be sure to define/describe ethical theories/approaches accurately and thenapply to individual actions.[Focus on what led up to the lawsuit not so much on whetherit is ‘ethical’ to sue, though that might merit some mention. ]Usually this question islimited to the plaintiff and defendant, but there might be other people or entities involvedin the ‘facts’. Consider the ‘facts’: what kind of problem developed that led to thelawsuit? Was the plaintiff ethical? Was the defendant ethical? Was anyone else involvedwho acted ethically? (Explain for each. Do you see any virtues? Any utilitarianism? Anyconsideration of ‘universal’ rulesthat ‘everyone’ should follow (Kant)?. What could have

been done to prevent the problem? ( A paragraph—incorporate ethical terms, rules. Usechapter 2)

 3. What is the lesson for business and businesspeople that this case offers? A paragraph.(Don’t generalize-no points for that. Focus on what happened in the case. Could it happento others? Is this case important for businesses to consider? How so? Back up your ideaswith specific examples, use of the case as well.).

4. Is the law/ court decision just? What purpose of the law served the community andwhat community interests were supposed to be advanced (do not use ‘the court system—

use the law or laws set out in the case). Was the outcome just? (Add your view of whatconstitutes justice) 2-4 sentences.

Session One: Case analysis is Due Monday September 19 at 11 pm). Requiresuploaded documents: the briefed case and the answers to the questions above. You maysubmit two separate documents or all in one.. (You must upload ONLY Doc, docx or apdf submission file, not other ‘types’ of files or no credit. )
