Three months ago, you purchased a small hotel that is located next to a bowling alley. The bowling alley is open until midnight. At least once per week, the police are called to the bowling alley because of some criminal activity that occurs on the premises of the bowling alley. Mark Johnson, who is a guest at your hotel, walks out of the hotel around 9:30 p.m. into a dark parking lot. He is robbed and severely beaten in the hotel parking lot. He observes the person who assaulted him run into the bowling alley and then leave the bowling alley with 2 other patrons. The police are called to the scene, but the person who robbed Mr. Johnson is never caught.

Six months later you are sued by Mark Johnson for personal injuries suffered at your premises. Mr. Johnson states that there was insufficient lighting in the parking lot, and therefore, he did not see the bowling alley patron before the assault. Additionally, the attorneys for Mr. Johnson state that the hotel should have provided security to protect its guests from intentional acts of third parties.

You assert that the hotel was not responsible for the acts of third parties. Further, you state that no criminal activities have occurred in your parking lot from the time you purchased the hotel until the assault of Mr. Johnson; thus, you could not have foreseen any potential problem.

Was the hotel negligent?
