The supervisor fired Sylvia because the hospital’s radiology director recommended Sylvia be removed from all areas using ionizing radiation, and the hospital could not find alternative work for her. After Sylvia was fired, she filed suit for violation of the Pregnancy Discrimination Act and Title VII. What do you think of her case?

After she was fired Sylvia, filed suit for violation of the Pregnancy Discrimination Act and Title VII. What do you think of her case.? I think that in Sylvia’s case the Pregnancy Discrimination Act will not protect her from being fired. Her job consist of coming in contact with ionizing radiation which is harmful to pregnant women. The radiology director ordered that she be removed from all areas of radiation for her own protection. In this case the hospital then tried but, was unable to relocate her to another department so she was fired. The hospital could then claim that firing Sylvia was a business necessity and was legitimately necessary due to harmful chemicals and her being pregnant. I feel that they should still award her maternity leave because she is pregnant and will soon not be able to work. Thanks Joy Norris
