While on patrol as a police officer, you stop a vehicle that is occupied by three men. The vehicle is being driven by David Driver. The front seat passenger is actually the owner of the vehicle (but is too intoxicated to drive). The passenger’s name is John Owner. The back seat passenger is identified as Jimmy Passenger. As you speak with the men, you smell marijuana and develop probable cause to search the vehicle. When you conduct the search, you find a small bag hidden under the center of the dashboard. The bag contains five grams of a white powder that tests positive for cocaine. No one in the vehicle admits to knowing anything about the bag, however Passenger hands you a small baggie of Marijuana that he had with him. The marijuana weighs approximately 10 grams.
