Assessing Competence

Forum #5: Central to this week’s readings Scott and Steinberg present evident that most adolescents fail to meet the criteria of being competent under the due process requirements of the law. They propose that in order to avoid many adolescents being found incompetent to stand trial, dual standards need to be applied between the juvenile and adult system. Discuss your position on this suggestion. Provide examples of potential problems that you feel the system might encounter when applying this dual system of assessing competence.
